Essex County Bankruptcy Credit Counseling Lawyer

Under the new bankruptcy laws that went into effect in 2005, anyone who plans to file bankruptcy must obtain credit counseling from a government-approved organization. In addition, debtors must complete a debtor education course in order to have their debts discharged.

What Is Credit Counseling?

Credit counseling includes an evaluation of your personal financial situation, a discussion of alternatives to bankruptcy and a personal budget plan. The course takes about 60 minutes, and can be completed online or on the phone. You will receive a certificate after completing this course.

Our lawyers will provide you with an approved New Jersey credit counseling organization that provides this course. You must complete this course before your debts can be discharged. Failure to complete the course will result in dismissal of your case.

What Is Post-Bankruptcy Debtor Education?

Debtor education includes information on developing a budget, managing money, using credit wisely and other financial topics. The course takes about two hours and can be completed online or on the phone. You will receive a certificate after completing the course.

In a Chapter 13 bankruptcy filing, you can complete the course any time within your three- to five-year payment plan. In a Chapter 7 bankruptcy, you must complete the course before you receive your discharge. If you do not complete the course, your case will be closed without the discharge of debts.
