Which remedies are available that can prevent foreclosures?

Sometimes, during difficult times, New Jersey homeowners may find it impossible to meet their mortgage obligations. Fortunately, remedial steps can be taken. During this stressful time, all options must be researched to prevent foreclosures. The research will show that available remedies include the assistance of foreclosure prevention counselors who may negotiate with mortgage companies for leniency, government programs and personal bankruptcy for protection under the U.S. Bankruptcy Code.

Chapter 13 bankruptcy can do more than prevent foreclosure

New Jersey consumers who are overwhelmed by mountains of debt may find comfort in learning that there are ways in which debt problems can be resolved without losing their homes and cars. Chapter 13 bankruptcy is one of the options available through the U.S. Bankruptcy Code to protect consumers against foreclosure, creditor harassment, wage garnishments and more. This option allows a consumer to continue paying off debts according to a court-approved payment plan.

Creditor harassment: Who is responsible for a parent's debts?

Consumers in New Jersey who don't know their rights could be conned into paying the debts of a deceased relative. The fact that the debts were solely in the name of a deceased parent may not stop creditor harassment, even though creditors cannot legally hold the children accountable. However, some debt collection agencies are ruthless, and they will send letters and make phone calls to coerce, bully and entice children to pay the debts anyways.

Joint credit card debt best addressed before finalizing divorce

The process of divorce is challenging, and, without professional guidance, important matters may be left unaddressed. As property division and child custody issues typically receive most of the attention of the parties during a divorce, existing credit card debt is often overlooked. Former spouses in New Jersey may find that these debts can come back to haunt them.
